1. Acceptance of Terms

By accessing, registering for, or using EmberNoir ("the Platform", "we", "us"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. These Terms constitute a binding legal agreement between you and EmberNoir.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Age Verification & Identity Requirements

You must be at least 18 years of age to access or use this Platform. By using EmberNoir, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

Provider Age Verification: All providers are required to submit a government-issued photo identification document (passport, driver's license, or provincial/territorial ID card) along with a current verification photo. This documentation is retained securely on file for legal compliance purposes.

ID Retention Policy: Verification documents submitted by providers are stored securely and used solely to confirm age and identity. They will be retained for the duration of your account and for a minimum period required by applicable law. Verification documents may be disclosed to law enforcement authorities when required by law.

Any attempt to use falsified identity documents, misrepresent age, or assist another person in accessing the Platform while underage is a criminal offence and will be reported to law enforcement immediately.

3. Adult Content Policy

EmberNoir is an adult-oriented classified advertising platform for consenting adults in Canada. The Platform permits advertising of legal adult services between consenting adults aged 18 and over.

3.1 Permitted Content

• Legal adult entertainment and companionship services
• Licensed massage and bodywork services
• Professional adult entertainment by verified adults
• Discreet, professional ad copy describing legal services
• "Playboy" level images — no explicit sexual acts, penetration, or sex toys

3.2 Prohibited Content

• Any content involving, referencing, or implying persons under 18
• Explicit pornographic images or videos
• Content soliciting or offering illegal sexual services
• Content suggesting non-consensual activity
• Content indicating coercion, force, or trafficking
• Pricing structures or language commonly associated with exploitation
• Hate speech, slurs, or discriminatory content
• Advertisements for illegal weapons, drugs, or other illegal goods
• Content impersonating another person
• Doxxing — posting private information about any individual

EmberNoir uses both automated AI moderation and human review to enforce these standards. Content that violates these policies will be removed without notice and the account may be permanently banned.

4. Anti-Trafficking & Exploitation Policy

Indicators of potential trafficking — including but not limited to: language suggesting a third party controls a provider, unusually low pricing, multiple ads from one device or IP with different names, or communication patterns suggesting coercion — are automatically flagged and reviewed by our moderation team.

5. Child Sexual Abuse Material (CSAM) Policy

Zero Tolerance. EmberNoir has an absolute zero-tolerance policy for child sexual abuse material (CSAM) and any content that sexualizes minors. This includes photographs, videos, illustrations, written content, or any other medium.

Any account found to be associated with CSAM will be immediately and permanently suspended. All evidence will be preserved in full and reported to:

• The Canadian Centre for Child Protection (cybertip.ca)
• Local law enforcement and/or the RCMP
• The National Center for Missing & Exploited Children (NCMEC) where applicable

We will never delete user data where a law enforcement investigation may be pending. Cooperation with law enforcement in CSAM cases is mandatory and unconditional.

6. Provider Verification

Providers wishing to post classified ads must complete our verification process. Verification requires:

• A valid government-issued photo ID confirming age (18+) and identity
• A current verification photo (selfie holding a handwritten note with your name and date)
• Selection of the appropriate service category

Verification is conducted by EmberNoir administrators and/or our AI verification system. Approval is at our sole discretion. Submitting falsified documents is a criminal offence.

Verified status confirms identity and age only. It does not constitute an endorsement of any provider, a guarantee of service quality, or a representation that any advertised services are legal in your jurisdiction.

Verification documents and data are retained securely. Providers consent to their verification data being disclosed to law enforcement when legally required.

7. User Accounts & Liability

You are solely responsible for all activity that occurs under your account. You agree to:

• Provide accurate and truthful registration information
• Maintain the confidentiality of your login credentials
• Notify EmberNoir immediately of any unauthorized account access
• Not share your account with any other person
• Not create multiple accounts without explicit admin authorization

User Liability: You are legally and financially responsible for all content you post, all transactions you initiate, and all interactions you conduct through the Platform. EmberNoir is a platform intermediary — we do not participate in, facilitate, or guarantee any transactions or services between users.

You agree to indemnify, defend, and hold harmless EmberNoir and its operators from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

8. Payment, Wallet & Refund Policy

EmberNoir operates a Litecoin (LTC) cryptocurrency wallet system for platform transactions. By depositing funds into your wallet, you acknowledge that:

• All purchases are final and non-refundable. This includes ad postings, upgrades, bumps, featured placements, and all other purchases.
• Cryptocurrency transactions are irreversible by nature. EmberNoir cannot reverse blockchain transactions.
• You are responsible for sending funds to the correct wallet address. Funds sent to incorrect addresses cannot be recovered.
• Exchange rates between LTC and CAD fluctuate. The rate at time of deposit confirmation is final.
• EmberNoir reserves the right to forfeit wallet balances of accounts that are suspended for policy violations.

Wallet balances are held on our platform and are not insured deposits. You use the wallet system at your own risk. We reserve the right to modify pricing with reasonable notice.

9. Privacy & Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms.

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Verification documents and identity data are handled with heightened security and access controls.

10. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMBERNOIR AND ITS OPERATORS DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

EMBERNOIR IS NOT LIABLE FOR: (a) any indirect, incidental, special, consequential, or punitive damages; (b) any loss of profits, revenue, data, or goodwill; (c) any damages arising from your interactions with other users; (d) any content posted by users; (e) any service interruptions or data loss; or (f) any unauthorized access to your account or data.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you paid to EmberNoir in the 30 days preceding the claim.

11. Termination

We reserve the right to suspend or terminate any account, with or without notice, for violations of these Terms or for any other reason at our sole discretion. Grounds for immediate permanent ban include:

• Any content involving minors
• Human trafficking or exploitation indicators
• Submission of falsified identity documents
• Harassment, threats, or doxxing
• Creating multiple accounts after being banned
• Chargebacks or payment fraud

Users may terminate their account at any time by contacting support. Account termination does not entitle you to a refund of any wallet balance or purchased services.

12. Governing Law

These Terms are governed by the laws of Canada and the province in which EmberNoir operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction. You consent to the exclusive jurisdiction of those courts.
